This website and all its related applications are operated and managed by the LuminaLuna LLC team. Throughout the site and any associated platforms, the terms “we”, “us”, and “our” refer exclusively to LuminaLuna LLC. LuminaLuna LLC offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your unconditional acceptance of all terms, conditions, policies, and notices stated herein.
By accessing our website, browsing our collections, or purchasing any bespoke product from us, you engage in our “Service” and formally agree to be bound by the following terms and conditions (“TERMS OF SERVICE”, “Terms”), including those additional terms, conditions, and policies referenced herein and/or available via hyperlink. These TERMS OF SERVICE apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, professional interior designers, and/or contributors of content.
Please read these TERMS OF SERVICE with the utmost care before accessing or using our website or application. By accessing or using any part of the site, you irrevocably agree to be bound by these TERMS OF SERVICE. If you do not agree to all the terms and conditions of this legal agreement, then you may not access the website, use any services, or initiate any bespoke projects. If these TERMS OF SERVICE are considered an offer, acceptance is expressly limited to these TERMS OF SERVICE.
SECTION 1 - LICENSE AND ACCESS
LuminaLuna LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the website and its tailoring applications strictly in accordance with the terms of this Agreement.
These Terms of Service constitute a legally binding contract between you (the individual or the entity you represent) and LuminaLuna LLC, the provider of the LuminaLuna website and the services accessible therein. Any breach or violation of any of these Terms will result in the immediate and automatic termination of your license and access to our Services without prior notice.
SECTION 2 - DEFINITIONS AND KEY TERMS
To ensure the clearest possible understanding of this Agreement, the following terms, whenever referenced, are strictly defined as follows:

Cookie: A small amount of data generated by our website and saved by your web browser. It is used to identify your browser, provide analytics, and remember information about you, such as your language preference or login information.

Company: When this agreement mentions “Company,” “we,” “us,” or “our,” it refers specifically to LuminaLuna LLC, a Wyoming limited liability company located at 30 N Gould St, Suite 1543, Sheridan, WY 82801, USA, which is the legal entity responsible for your information and financial transactions under these Terms.

Bespoke/Custom Products: Refers to window treatments, curtains, drapes, shades, textiles, and hardware that are hand-crafted, modified, or tailored specifically based on the unique measurements, fabric selections, and header specifications provided by the User at the time of order.

Service: Refers to the collective suite of services provided by LuminaLuna, including but not limited to the online storefront, the proprietary tailoring and pricing algorithms, customer consultation, and international logistical fulfillment.

Device: Any internet-connected device such as a smartphone, tablet, computer, or any other hardware capable of visiting the LuminaLuna website and utilizing its services.

You/User: A person or legal entity that has registered with or purchased from LuminaLuna to use the Services.
SECTION 3 - BESPOKE SPECIFICATIONS AND USER RESPONSIBILITY
LuminaLuna specializes in high-precision, artisan hand-tailored products. Because these items are not mass-produced and are created based on your specific input, you acknowledge and agree to the following:

Absolute Accuracy of Data: You are solely and exclusively responsible for the accuracy of all measurements (Width and Length), fabric selections, lining options, and header styles submitted through our tailoring application.

Measurement Guidelines: We provide comprehensive measuring instructions and video guides. By placing an order, you represent and warrant that you have read, understood, and followed these instructions precisely. LuminaLuna LLC is not liable for fitment issues, aesthetic dissatisfaction, or installation failures resulting from incorrect data provided by the customer.

Industry-Standard Tolerances: You acknowledge that a variance of +/- 1/2 inch (1.27 cm) is a standard industry tolerance for hand-crafted textiles. Such variances are inherent to the artisanal tailoring process and shall not be considered a manufacturing defect or grounds for a return.

Digital vs. Physical Color Variance: While we employ high-resolution photography and color-calibration, actual fabric colors and textures may vary slightly from screen images due to monitor settings and lighting. We strongly advise ordering Fabric Swatches prior to a full bespoke order. LuminaLuna LLC will not accept returns based on "color mismatch" or "texture preference" if the customer did not order and verify a physical swatch beforehand.
SECTION 4 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us your express consent to allow any of your minor dependents to use this site.
You may not use our bespoke products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws and safety regulations such as the CPSC Window Covering Safety Standard).
A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 5 - GENERAL CONDITIONS
We reserve the express right to refuse service to any individual or entity, for any reason, at any absolute time.
You understand that your content (specifically excluding sensitive credit card information), may be transferred unencrypted and involve (a) transmissions over various global networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks via Shopify Payments, which adheres to the highest industry standards (PCI-DSS).
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by LuminaLuna LLC.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 6 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
While we strive for excellence, we are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making critical decisions without consulting primary, more accurate, more complete, or timelier sources of information. Any reliance on the material on this site is strictly at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
SECTION 7 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our bespoke window treatments are determined by our proprietary tailoring algorithms and are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.
In the event that our custom application (hosted via Fly.io) generates an incorrect price due to a technical glitch or logic error, LuminaLuna LLC reserves the right to cancel the order and provide a full refund, regardless of whether the order has been confirmed or your credit card charged.
SECTION 8 - PAYMENT AND TRANSACTION TERMS (FULL PAYMENT MODEL)
By placing an order for a bespoke project, you agree to the following financial terms:

Full Pre-payment Required: Unlike mass-market retailers, LuminaLuna LLC requires the full transaction amount to be successfully captured and verified at the time of checkout.

Production Initialization: No bespoke project will enter the tailoring phase, nor will any fabric be reserved, until the full payment has been confirmed by our payment gateway.

Payment Providers: We accept major credit cards and other payment methods as displayed on our checkout page. You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) utilized in connection with any transaction.
SECTION 9 - CANCELLATION AND MODIFICATION POLICY (THE BESPOKE EXCEPTION)
Given that our products are tailored to individual requirements, they cannot be resold to other customers. Therefore, the following strict policy applies to all orders:

The 24-Hour Grace Period: Customers are granted a twenty-four (24) hour window from the precise timestamp of order placement to request a full cancellation or any modifications to dimensions, fabric, or style.

Irrevocable Commitment: Immediately upon the expiration of the 24-hour window, the bespoke project is electronically transmitted to our tailoring unit. At this point, the fabric is professionally cut to your specifications.

Post-24 Hour Status: Once the fabric has been cut, the order is considered final and non-refundable. No cancellations, exchanges, or "change of mind" refunds will be authorized under any circumstances after this 24-hour threshold.

Customer Error: If you realize an error in your measurements after the 24-hour period, please contact support@luminalunastudio.com immediately. While we cannot offer a refund, we may, at our sole discretion, offer a discount on a replacement order to help rectify your situation.
SECTION 10 - ALL-INCLUSIVE DDP SHIPPING AND DELIVERY
LuminaLuna LLC utilizes a specialized "Vertical Studio" logistics model to serve our customers in the United States and Canada. By purchasing from us, you agree to the following delivery terms:

DDP (Delivered Duty Paid) Terms: For all orders bound for the United States, we provide comprehensive DDP service. This means LuminaLuna LLC assumes full legal and financial responsibility for all import duties, customs clearance fees, brokerage charges, and international taxes. The price confirmed at checkout is the final price; you will not be required to pay additional fees to any carrier or government authority upon delivery.

Carrier Selection: We reserve the right to select the most reputable carrier (typically UPS, FedEx, or DHL Express) based on the specific weight and destination of your bespoke project.

Signature Requirement: To safeguard your investment, a recipient signature is mandatory for all high-value shipments exceeding $800.00 USD. We cannot waive this requirement, and LuminaLuna LLC is not liable for packages left unattended at the doorstep if a signature waiver was requested directly from the carrier by the customer.

Tracking and Status Updates: You will receive a US-based tracking number once your project clears customs and enters the domestic sorting facility. You acknowledge that there may be a "Static Period" of 3 to 7 business days where the tracking status remains "Label Created" while the package undergoes international customs processing.

Shipping Restrictions: We strictly cannot deliver bespoke curtains or hardware to P.O. Boxes, APO, FPO, or DPO addresses due to carrier restrictions and the high value of the items.
SECTION 11 - MANUFACTURING DEFECTS AND WARRANTY CLAIMS
We take immense pride in our artisanal craftsmanship. In the rare event that a product arrives with a genuine manufacturing error, the following terms apply:

Notification Window: Any claims for defects, damage, or measurement discrepancies (outside the standard 1/2 inch tolerance defined in Section 3) must be reported to support@luminalunastudio.com within seven (7) calendar days of the delivery timestamp.

Evidence Requirements: To process a claim, you must provide your Order ID along with high-resolution, unedited photographs or video footage clearly demonstrating the issue. For measurement disputes, a measuring tape must be clearly visible in the frame showing the discrepancy.

The "Remake First" Policy: As our products are custom-made and cannot be resold, our primary resolution is a Priority Remake at no additional cost to you. Monetary refunds are only issued at the sole discretion of our technical team if a remake is deemed technically impossible.
SECTION 12 - THIRD-PARTY TOOLS AND EXTERNAL SERVICES
We may provide you with access to third-party tools or utilized integrated services (such as our Custom Tailoring Engine hosted via Fly.io or logistics tracking via carrier APIs) over which we neither monitor nor have any direct input or control.

As-Is Availability: You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations, or conditions of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools or any technical downtime caused by cloud infrastructure providers.

Future Features: We may also, in the future, offer new services and/or features through the website (including, the release of new tailoring modules or design resources). Such new features and/or services shall also be subject to these Terms of Service.
SECTION 13 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain specific submissions (for example, photos of your installed curtains for our gallery) or without a request from us you send creative ideas, suggestions, proposals, or other materials (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.
We are and shall be under no obligation:

To maintain any comments in confidence;

To pay compensation for any comments;

To respond to any comments.
SECTION 14 - PROHIBITED USES
In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances (including but not limited to the Consumer Product Safety Commission (CPSC) standards regarding corded window coverings); (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of our Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service.
We reserve the right to terminate your use of the Service or any related application for violating any of the prohibited uses.
SECTION 15 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service—specifically the precision of our automated tailoring calculations—will be absolute, notwithstanding our best efforts to ensure algorithmic accuracy.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall LuminaLuna LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
SECTION 16 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless LuminaLuna LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 17 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 18 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 19 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
SECTION 20 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.
SECTION 21 - DISPUTE RESOLUTION AND BINDING ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS. Any dispute or claim arising out of or relating in any way to your use of the LuminaLuna Service, or to any products or services sold or distributed by LuminaLuna LLC will be resolved by binding arbitration, rather than in court.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court.
Class Action Waiver: We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.
